Cross-border email programs must satisfy the legal framework of the recipient's jurisdiction alongside the technical policies of their mailbox provider. Part 3 of our deliverability engineering series summarizes the primary statutory requirements and how email hygiene supports data-accuracy obligations.

European Union and UK (GDPR and ePrivacy)

  • Lawful basis and accuracy: Article 5(1)(d) of the GDPR requires controllers to keep personal data accurate and up to date, erasing or rectifying inaccurate records without delay. Removing invalid and deactivated addresses via email verification directly supports data-hygiene compliance.
  • Data minimization and retention: delete raw verification uploads once cleaned results are synced to your CRM, using on-demand job deletion in the ValidReach dashboard.

Canada (CASL)

Canada's Anti-Spam Legislation (CASL) requires express or narrow implied consent (with strict time windows for existing business relationships), clear sender identification and a working unsubscribe mechanism that is honored promptly.

United States (CAN-SPAM and state privacy laws)

The CAN-SPAM Act prohibits deceptive headers or subject lines, requires a valid physical postal address and mandates a clear opt-out mechanism honored within 10 business days. State laws such as the CCPA/CPRA add notice and opt-out rights over personal data sharing.

Operational implementation

  1. Record the consent timestamp, source URL and jurisdiction alongside every email address at capture.
  2. Verify syntax, MX records and mailbox status before sending confirmation or welcome mail.
  3. Maintain a unified global suppression list so opt-outs and hard bounces are enforced across every region and workspace.
